Terms of Service

These Terms of Service ("Terms") govern your access to and use of Trend Tap, including the Figma plugin and this website (collectively, the "Service"), operated by Girtonian LLC ("Girtonian," "we," "us," or "our"). By installing, accessing, or using the Service, you agree to these Terms.

1. The Service

Trend Tap is a Figma plugin that provides curated design-trend prompts and related creative-direction tools for AI image generation workflows (including Figma's Make an image / Weave and external tools such as Midjourney and DALL-E). The Service helps you browse trends, build prompts, copy them to your clipboard, and optionally attach metadata to Figma layers.

2. Eligibility

You must be able to form a binding contract to use the Service. If you use Trend Tap on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Free and Plus Tiers

Free tier. Includes access to a subset of design trends and basic controls (such as aspect ratio presets). No payment is required.

Plus tier. Unlocks additional trends and advanced controls (including sticker modes, themes, chibi mode, patch types, and color modifiers). Plus is purchased as a one-time digital license through our authorized checkout provider, currently Lemon Squeezy.

We may change which features belong to each tier, add new features, or adjust pricing for future purchases. Changes will not retroactively remove Plus access you have already paid for, except as required by law or in cases of fraud or abuse.

4. Plus License

When you purchase Plus, you receive a personal license key subject to the following conditions:

• The license grants you a non-exclusive, non-transferable right to use Plus features in Trend Tap.
• License keys are intended for the purchaser and may be subject to activation limits enforced by our license provider.
• You may not share, resell, sublicense, or publicly distribute license keys.
• We may deactivate licenses obtained through fraud, chargebacks, or violation of these Terms.

License activation requires an internet connection to verify your key with Lemon Squeezy. After activation, Plus may continue to work offline for a limited grace period before re-validation is required.

5. Third-Party Services

The Service integrates with or links to third-party platforms, including:

• Figma — required to run the plugin; subject to Figma's terms and policies
• Lemon Squeezy — processes payments and license validation
• AI image tools — prompts you copy may be used in Figma Make an image, Midjourney, DALL-E, or other services, each governed by its own terms

We are not responsible for third-party services, their availability, pricing, or outputs.

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the prompt library or source code except where permitted by law
• Circumvent Plus licensing, activation limits, or technical access controls
• Use the Service to generate or facilitate unlawful, infringing, harassing, or harmful content
• Interfere with the Service's operation or impose an unreasonable load on our systems or providers
• Misrepresent affiliation with Trend Tap or resell the Service as your own product

7. Intellectual Property

Trend Tap, including its name, branding, UI, trend curation, and prompt library, is owned by Girtonian LLC or its licensors and protected by intellectual property laws. These Terms do not grant you ownership of the Service or its content.

You retain ownership of your Figma files and any images you create. Prompts generated through the Service are provided for your creative use, but we make no claim to ownership of AI outputs you produce with external tools.

8. AI and Creative Outputs

Trend Tap provides prompt suggestions and creative-direction metadata. It does not generate images itself. AI tools may produce unexpected, inaccurate, or low-quality results. You are solely responsible for reviewing outputs before use in client work, commercial projects, or public distribution.

We do not guarantee that prompts will comply with any AI provider's content policies or produce rights-cleared results. You are responsible for complying with the terms and usage policies of each AI platform you use.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, compatible with every Figma workflow, or that prompts will achieve specific visual results.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIRTONIAN LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR PLUS IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Refunds

Digital Plus licenses are generally non-refundable once delivered, except where required by law or where our payment provider's refund policy applies. Refund requests for purchases made through Lemon Squeezy should be directed through Lemon Squeezy's support process or by contacting us at connect@girtonian.com.

12. Termination

You may stop using the Service at any time by uninstalling the plugin. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use Plus features ends, though provisions that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will remain in effect.

13. Changes

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.
